Establishing heirs

Establishing on the heiress the trace of death on the owner of the property, the legal procedure is important, which usually follows the determination of the step, which is determined by the time horizon for the execution of it by him.

Step 1: Obtain a Death Certificate.

The initial step in establishing heirs is obtaining a Death Certificate. This document confirms the fact of the person's death and is necessary to start the entire inheritance process.

A death certificate is a legally binding document that officially certifies a person's death.

Death Certificate Issuance Process:

1. After a person's death, regardless of where it occurred, a medical practitioner must issue a death certificate. This action is essential because it depends on it to begin the process of issuing a Death Certificate.

2. Issuance of Death Certificate: Death certificates can be issued no later than 48 hours after death. To obtain a Death Certificate, you need to provide a medical death certificate issued by a competent medical practitioner (item 1), together with an identity document of the deceased and an identity document of the declarant.

Term, fees and validity of Death Certificate:

The death certificate is issued free of charge, and the document handed over to the announcer is a copy of the original death certificate. The original document is kept in the municipality from which it was issued indefinitely. If the document is lost, a new copy can be obtained from the specific municipality.

Step 2: Establishing the heirs - issuing a Certificate for heirs,

After receiving the Death Certificate, the heirs should be established.

For this purpose, it is necessary to issue a "Certificate for Heirs". It is issued by the municipality, district or town hall where the last permanent address of the deceased person is located.

Process of Issuance of Heirs Certificate:

The request for issuing a certificate for heirs can be submitted on a paper form according to a sample at a place in the municipality or electronically, signed with an electronic signature by the applicant. In addition to the issuance form, a copy of the Death Certificate and payment of a fee for the issuance of the document are required. If the documents are submitted by a proxy and not by a direct heir, a power of attorney is required.

More information:

When submitting the documents for the issuance of a Certificate of Inheritance by a parent or guardian parent, the child's birth certificate and the custody decision (if submitted by the parent guardian) are required. If the person who submits documents for the issuance of the certificate is not an heir or an authorized person, it is necessary to provide a court certificate.

The document can be received at the place of submission in the municipality, by electronic means, courier or registered letter.

Term, fees and validity of the Successor Certificate:

The heir certificate does not have a specific deadline, but it is needed for other processes that are framed by different deadlines. By itself, the Certificate of Successors is taken out when necessary. The amount of fees for issuing the document is determined by each municipality independently and varies according to the type of service according to the applicant's preference - express (up to BGN 20), fast - up to 3 days, or ordinary - up to 7 days (about BGN 10) service. The document does not have a specific period of validity, but a new one is required if there is a change in the information it contains.

Step 3: Determination of the inherited property

Once the heirs have been established, the next step is to determine the inheritance. This includes extracting information about the property to be distributed, such as real estate, funds, bank accounts and other assets.

Based on the established heirs and estate, all necessary inheritance taxes should be paid. The property is then distributed according to the legal inheritance shares of the established heirs.
